Definitions
Terms used below are defined as follows:

Customer - natural person, legal entity, or organisation other than legal entity, which has legal fitness, and which places an Order with SJRecords online store;

Civil Code - Act Of 23 April 1964 Civil Code (Journal of Laws of the Republic of Poland no. 16, item 93, amended);

Terms of Use - these Terms of Use of SJRecords online store and its electronic services

Online Store (Store) - online service available at www.sjrecords.eu, through which the Customer may place Orders

Goods - goods offered by the Online Store

Sale Agreement - agreement to sell Goods, as defined in the Civil Code, between the entity operating the Online Store and the Customer, entered into by means of the Online Store;

Specific Terms and Conditions of Consumer Sale Act of 27 July 2002 and amendments to the Civil Code (Journal of Laws of the Republic of Poland no. 141, item 1176, amended);

Act on Rendering Electronic Services - Act of 18 July 2002 (Journal of Laws of the Republic of Poland no. 144, item 1204, amended);

Order - declaration of intent by the Customer, which generates the Sales Agreement and determines, among others, type and number of Goods.
Moreover, this website uses terms for products and offers provided by Wydawnictwo SJRecords. These are defined as follows:

CD Album - physical album, to be shipped to the address given on order placement.

MP3 Album - all the music as recorded on a physical CD Album, available to download as MP3 files.

MP3 Song - individual piece of music, available to download as MP3 files.

Promotional Offer - an offer to buy five CD Albums at a reduced price. More information in the Promotional Offer Terms and Conditions.

General Provisions

These Terms of Use determine the use of the Online Store at www.sjrecords.eu

These Terms of Use are governed by article 8 of the Act on Rendering Electronic Services.

These Terms of Use determine in particular:

terms and conditions of online orders with the Online Store;

terms of Agreements of Sale of goods and services offered by the Online Store.

Customers may refer to these Terms of Use at all times by following the link at the www.sjrecords.eu homepage, and by copying the text into a text editor and printing for own use.

Details of Goods available at the Online Store’s web pages constitute an invitation to enter into an Agreement of Sale, as defined by Art. 71 of the Civil Code.

Terms of Use of the Online Store

Registration on this website is achieved by filling in the Registration Form and accepting the Terms of Use, or by placing an order with the Online Store on this website.

By using this website the Customer acknowledges and agrees to these Terms of Use.

A purchase from the Online Store if only possible by submitting the personal details necessary to process the order.

If the Customer has no Customer Account, the Account will be automatically created during the placing of the order. An email will be sent confirming the creation of the Customer Account, and showing how to log into it.

If the Customer has a Customer Account and makes a purchase without logging in, they will be automatically logged in, and the details of the purchase automatically attributed to their account, upon submitting the matching email address.

If the Customer loses the login details they may recover access through the ‘Send New Password’ button.

The Operator of the Online Store may suspend a Customer’s Account, or limit the Customer’s access to the Store, if the Customer violates these Terms of Use, and in particular, if:

the Customer submitted upon registration false, incorrect or out-of-date details, misleading or prejudicing the rights of third parties,
-
the Customer, through their use of the Online Store, causes infringement of personal interests of third parties, and in particular of other Customers of the Store.

the Customer acts in ways which the Operator of the Online Store may interpret as illegal or contrary to general conditions of the use of the Internet, or damaging the reputation of the Operator.

The person whose Customer Account has been suspended may not re-register without express consent by the Operator of the Online Store.

In order to safeguard data and communication security within and involving www.sjrecords.eu, and relating to the website’s services, the Online Store takes technical and organisational measures appropriate to the threat level for services rendered, and in particular measures aiming to prevent theft and modification by unauthorised persons of personal data sent via www.sjrecords.eu.

The Customer may not:

send and deliver illegal content, e.g. defamatory, inciting to violence, or infringing personal interests of third parties,
-
use the Online Store in ways which interfere with its operation, by use of software or hardware,
-
use the Online Store to send and publish spam.

use the Online Store in ways which are disruptive to other Customers or store Operator.

use the contents of the Online Store for personal use only,
-
use the Online Store in ways which break the Laws of the Republic of Poland, these Terms of Use, and the general principles of Internet use.

Sales Agreement Conclusion Procedure

To conclude a sales agreement through the Online Store the Customer must visit the www.sjrecords.eu website, select their desired Goods via a series of onscreen instructions and based on information available on the website.

The selection of the desired Goods happens by adding the Goods to the Basket.

During Order placement - until the clicking of the “place the order” button - the Customer is able to change any information and requests submitted. To do so, they must follow information and instructions available on the website.

After submitting all the necessary information, the Customer will receive an email with a link to Order Summary. The Summary will comprise:

List of ordered Goods,
-
unit and total prices of ordered Goods.

To place the Order the Customer must accept the Store’s Terms of Use, fill in the personal details marked as compulsory, click “place the order” button, and pay vie total price via PayPal.

Order placement by the Customer constitutes the Customer’s declaration of intent to enter into a Sales Agreement with the Operator of the Online Store, as per the Terms of Use.

On Order placement the Customer receives an email with a confirmation of all key elements of the Order.

The Sales Agreement is concluded upon receipt of the above-mentioned email by the Customer.

The Sales Agreement is in the Polish language, and in accordance with these Terms of Use.

Prices and payment methods
-
Prices of Goods are given in Polish złotys and inclusive of all taxes and charges.

The Customer pays as instructed via the chosen payment method, on the appropriate web page, or by bank transfer to bank account 96 1050 1214 1000 0091 2354 8720.

Delivery
-
Delivery of Goods is to the address given by the Customer during Order placement. The the Goods constitute an electronic file, the Customer downloads it and has permanent access to it through their Customer Account.

Delivery of physical Goods is by post.

Delivery takes from 3 to 7 working days from the receipt of payment funds.

Recording, securing, disclosing and confirming key elements of the Order is done by sending of an email message to the Customer, and by delivering a printed Order Confirmation and receipt together with the delivery of physical Goods.

Right of withdrawal
-
The Customer is a consumer, as per Art. 221 of the Civil Code, and as such may, according the laws of the Republic of Poland, withdraw from a Distance Contract without giving reason by submitting within 14 days a written declaration of intent to withdraw and sending it to the address of the Operator of the Online Store.

The limit of 14 days counts from the delivery of Goods.

A consumer’s right of withdrawal does not apply to electronic files, or music and audiovisual recordings and software on electronic data storage media, after the consumer has removed the packaging;
-
Withdrawing from a Distance Contract renders the contract (Sales Agreement) void. Goods and payments must be returned unchanged. The return must be prompt, within 14 days. Goods should be returned to: Marek Różycki, ul. Rybnicka 43, 43-190 Mikołów.

The Customer returning Goods should pack them appropriately, ensuring the Goods are not damaged in transit.

The Customer is responsible for the cost of packaging and posting the returned Goods.

The SJRecords Online Store reserves the right to void the Order, or charge balance, should the price charged for the Customer’s Order be incorrect due to technical error.

Physical Goods Returns and Complaints
-
The Operator of the Online Store is a seller, as per Art. 221 of the Civil Code, and as such is responsible to the Customer for the conformity of Goods bought by the Customer with the Sales Agreement, to the extent defined in the Act on specific terms and conditions of consumer sales.

Complaints resulting from violation of consumer rights, safeguarded legally or by these Terms of Use should be addressed to kontakt@sjrecords.eu. The Operator of the Online Store undertakes to consider every complaint within 14 days or else to inform the Customer within 14 days, when their complaint shall be considered.

Electronic services Returns and Complaints

The Operator of the Online Store takes steps to ensure the Store’s correct functioning in such extent as results from current and available information technology and undertakes to eliminate any errors reported by Customers.

The Customer ought to notify the Operator of any errors or interruptions in the functioning of the Online Store.

Errors or interruptions in the functioning of the Online Store ought to be reported to kontakt@sjrecords.eu.

The error report should include the Customer’s name, correspondence address, type and date of the error.

The Operator of the Online Store undertakes to consider every report within 14 days or else to inform the Customer within 14 days, when their report shall be considered.

Final Provisions

Settlement of any disputes between the Operator of the Online Store and the Customer who is a consumer, as per Art. 221 of the Civil Code, shall be submitted to courts having jurisdiction in accordance with the appropriate articles of the Civil Code.

Settlement of any disputes between the Operator of the Online Store and the Customer who is not a consumer, as per Art. 221 of the Civil Code, shall be submitted to a court having jurisdiction over the Operator's seat.

Matters unregulated by these Terms of Use shall be subject to the Civil Code, Act on Rendering Electronic Services, and other laws of the Republic of Poland.
